Dollar General 300 Truck Giveaway

1) NO PURCHASE NECESSARY TO ENTER OR WIN. PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

2) Eligibility: Dollar General 300 Truck Giveaway (the “Promotion”), which is being conducted in conjunction with the Dollar General 300 to be held at Lowe’s Motor Speedway on October 10, 2008 (the “Event”), is open to persons who are at least eighteen (18) years of age and who have a valid U.S. driver’s license and proof of automobile liability insurance as required by the participant’s state of residence current as of the time of entry and the time to collect any prize won.  The Promotion is void in New York, Rhode Island, Florida and Puerto Rico and residents thereof are not eligible to enter or win the Promotion.  In addition, the following are not eligible to enter or win  the Promotion: employees, officers and directors of Lowe’s Motor Speedway (“Sponsor”), Speedway Motorsports, Inc. (“SMI”) and Dollar General (“DG”) and each of their respective parent companies, subsidiaries, affiliates, distributors, retailers, dealerships, officers, directors, governors, related entities, partners, partnerships, principals, agents, licensees, sponsors, representatives, successors and assigns, and advertising/promotion/administrative agencies (collectively “Released Parties”) and their immediate family members (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) and those living in their same households, whether or not related, for any of the above named entities are not eligible to participate or win. Void where prohibited or restricted by law, rule or regulation. This Promotion is subject to all applicable federal, state and local laws, rules and regulations.

3) How to Participate: NO PURCHASE NECESSARY.  Any person who is eligible pursuant to paragraph 2 may enter the Promotion by any of the following means of entry until 11:59PM on Tuesday, October 7, 2008 at which time the entry period (described below) shall end: (i) coming in person to the Ticket Office of Lowe’s Motor Speedway located at 5555 Concord Parkway South, Concord, North Carolina and completing an entry form that will require submitting the entrant’s full name, address, city, state, zip, email address, mobile and/or home phone number (including area code); (ii) going to www.lowesmotorspeedway.com and entering online by submitting the same information required for the paper entries; or (iii) purchasing or having purchased a ticket as an individual(s) to the Event prior to 11:59PM on Tuesday, October 7, 2008, provided, however, that all holders of tickets acquired through trade, complimentary donation, or corporate sales shall not be automatically entered and such individuals must enter in person if they wish to do so at the ticket office, online or by purchasing a ticket as set forth above. The entry period begins Friday, September 19, 2008 at 9:00AM and ends Tuesday, October 7 at 11:59PM.  There is a limit of one (1) entry per person and per household regardless of the method of entry. Multiple entries received from any one person or household after the first entry received from that person or household will be void. Released Parties are not responsible for lost, late, stolen, incomplete, damaged, garbled, delayed, undelivered, inaccurate, incorrect, illegible or misdirected entries (including those that are automatic by virtue of ticket purchase), mail, email, messages or transmissions, interrupted or unavailable network, satellite, cable, Internet Service Provider (ISP), server, website or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines or technical failures, errors or difficulties, malfunction of phones, phone lines or telephone systems or other communication malfunctions, errors, difficulties or malfunctions, garbled, jumbled, misrouted, scrambled, delayed or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether mechanical, human, network, electronic, computer, typographical, printing or otherwise relating to or in connection with the Promotion, including, without limitation, errors or difficulties which may occur in connection with the administration of the Promotion, the announcement of the Winner, the cancellation or postponement of the Event, including the “Promotion” or the processing of entries; for inaccurate entry or other Promotion related information, printing, typographical or other errors appearing in these Official Rules, or in other promotion related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by website users, tampering, hacking, or by any equipment or programming associated with or utilized in the Promotion. Released Parties are not responsible for injury or damage to participants. Persons who tamper with or abuse any aspect of the Promotion or attempt to undermine the legitimate operation of the Promotion by cheating, deception or other unfair playing practices, or intend to annoy, abuse, threaten or harass any other entrant or Sponsor’s representatives or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void. Any attempt to deliberately damage the content or operation of this Promotion is unlawful and subject to legal action by the Sponsor, Dollar General or their respective agents. By participating, entrants agree to abide by these Official Rules and to the decisions of the Sponsor, which shall be final and binding in all matters relating to this Promotion.

4) Prize: There will be one (1) Toyota Tundra Truck (the “Prize”) given away under this Promotion having a Total Approximate Retail Value (“ARV”) of $26,765 US. There will be one (1) winner. The winner is responsible for all federal, state, local and provincial taxes, insurance, ground transportation (other than that described above) and for any other costs and expenses associated with acceptance of the Prize and use not specifically stated herein including costs associated with receipt, taxes, titling, registration, emissions compliance, ownership, possession, acceptance, maintenance, enjoyment, use or misuse of Prize.  Any selected participant must provide proof a valid driver’s license and automobile liability insurance before claiming the Prize. Failure to do so may result in forfeiture of the Prize. If the Event is cancelled, there is no obligation to award the Prize or select a winner and no compensation or substitution will be provided in lieu thereof. The Released Parties will not be responsible for Acts of God, acts of terrorism, civil disturbances, work stoppage or any other events that may cause the cancellation or postponement of the Promotion.

5) Prize Drawing(s): There will be a random drawing to determine the one (1) winner (the “Winner”). The drawing will be conducted sometime prior to the Event and the Winner will be announced at the Event; the drawing shall be random selecting from among all eligible entries received during the entire Entry Period.  If the entrant selected as the apparent Winner is not planning on attending the Event, he or she must be present on the grounds of Lowe’s Motor Speedway to be the Winner and collect the Prize; such non-attending entrant will be notified immediately following his or her selection and at such time given instructions on how to enter the facility for the announcement and the awarding of the Prize. Upon being notified of his or her selection, the apparent Winner shall: (a) provide Sponsor with information confirming his/her eligibility; and (b) provide means by which he or she can receive (preferably, an email address or fax number) an affidavit of eligibility, liability and publicity release (where legal). Upon verbal acceptance of these requirements, the apparent Winner will be allowed forty-eight (48) hours from time of initial notification to complete and return required documents by email or fax or entrant may be disqualified, the Prize will be forfeited and Sponsor may select an alternate winner. If an alternate potential Winner who is selected after the Event does not answer phone (or is otherwise unavailable during initial contact attempt), no message will be left and no further attempt to contact such individual will be made, that individual will be disqualified and an alternate potential Winner chosen. By participating, entrants agree to be bound by these Official Rules and to the decisions of the Sponsor, which will be final and binding in all respects.

Odds of being selected as a Prize winner depend upon the total number of eligible entries received.

6) Miscellaneous: No transfer, assignment, cash redemption, or substitution of Prize permitted except by Sponsor who reserves the right to substitute a Prize with one of comparable or greater value, at its sole discretion. Failure to satisfy any of the foregoing, comply with these Official Rules, the inability of Sponsor to contact a potential Winner within a reasonable time period as described herein or a Prize notification being returned as non-deliverable for any reason will result in disqualification, such Prize being forfeited and, at Sponsor’s discretion, an alternate Winner may be selected from all remaining eligible entries. By entering, entrants agree: 1) that Sponsor, Dollar General and each of their respective designees shall have the right and permission to use entrant’s name and/or picture, photograph, image, video, or biographical information or voice and/or other likeness and prize information for trade, advertising, promotional and/or any other purposes in any media or format now known or hereafter devised throughout the world in perpetuity without any further compensation, consideration, permission or notification except where prohibited by law; and 2) that the Released Parties and their designees and assigns shall have no liability and will be held harmless for any liability, loss, injury or damage, including, without limitation, personal injury, death or damage to personal or real property, to entrant or any other person or entity due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of a prize and/or participation in this Promotion. Sponsor and Dollar General, as applicable, reserve the right, in each one’s sole discretion, to void suspect entries and/or modify, terminate or suspend this Promotion (or any portion thereof) should a virus, bugs, non-authorized human intervention or other causes corrupt or impair the administration, security, fairness or proper operation of the Promotion (or any portion thereof). In the event of termination of the Promotion, Sponsor may, at its discretion, select Winner from all eligible, non-suspect entries received prior to event requiring such termination. In the event of a dispute as to the identity or eligibility of an entrant, such entry will, at Sponsor’s sole discretion, be disqualified.

7.) CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY ASPECT OF OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR WILL DISQUALIFY ANY SUCH ENTRANT, AND SPONSOR, DOLLAR GENERAL, THE APPLICABLE ENTITIES AND THEIR RESPECTIVE AGENTS RESERVE THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.

8.) LIMITATION OF LIABILITY:  By entering, entrants (a) agree to these Official Rules, and the decisions of Sponsor, which shall be binding and final in all respects; and (b) acknowledge that Sponsor has not made nor is in any manner responsible or liable for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relating to Prize. By participating, the Winner releases Sponsor, its parent company Speedway Motorsports, Inc., Dollar General and each of their respective officers, directors, managers, employees, affiliates, subsidiaries, advertising, promotion, fulfillment, marketing agencies, public relation firms, consultants or contractors from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses to persons (including death) and property which may be sustained in connection with the receipt, taxes, titling, registration, emissions compliance, ownership, possession, acceptance, enjoyment, use or misuse of a prize, or arising out of participation in this Promotion, or while preparing for, participating in, and/or traveling to and from taking delivery of the Prize or any prize-related activity.  Sponsor expressly disclaims any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use of the Prize awarded or for any vehicle’s noncompliance with the winner’s state and/or local motor vehicle regulations.  IN NO EVENT WILL SPONSOR, SPEEDWAY MOTORSPORTS, INC., DOLLAR GENERAL OR ANY OF THEIR RESPECTIVE OFFICERS, DIRECTORS, MANAGERS, EMPLOYEES, AFFILIATES, SUBSIDIARIES, ADVERTISING, PROMOTION, FULFILLMENT, MARKETING AGENCIES, PUBLIC RELATION FIRMS, CONSULTANTS OR CONTRACTORS BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING WITHOUT LIMITATION DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, ARISING OUT OF ANY ACCEPTANCE, POSSESSION, USE OR MISUSE OF ANY PRIZE AWARDED IN CONNECTION WITH THIS PROMOTION, INCLUDING WITHOUT LIMITATION, PERSONAL INJURY, DEATH AND/OR PROPERTY DAMAGE, AS WELL AS ANY CLAIMS BASED ON PUBLICITY RIGHTS OR INVASION OF PRIVACY.

9) Notice of Winner: For the name of the Winner, after October 20, 2008, send a stamped, self-addressed envelope to: Dollar General 300 Truck Giveaway, c/o Lowe’s Motor Speedway, Corporate Sales Department, P.O. Box 600, Concord, NC 28026.
